Pubblichiamo di seguito, in lingua inglese, un estratto da un commento più ampio al tema in oggetto redatto dai Colleghi del Dipartimento Energy di Bucarest. Essendo la questione molto controversa, ed avendo ricevuto diversi commenti, abbiamo ritenuto utile postare quanto di seguito riportato.
“According to the relevant regulatory framework ( i.e. Law no. 220/2008 on the promotion of renewable energy sources, Order no. 42/2011 approving the Regulation on the authorization of the promoting system) the Investor may cumulate the state aid, including EU Structural Funds, with the promoting system of green certificates.
Nevertheless, in the light of art. 6 para. 7 of Law no. 220/2008 and art. 20 of Order no. 42/2011, the Romanian Energy Regulatory Authority will dispose a reduction of the number of green certificates to which the Investor would have been entitled to if he had not benefited of EU Structural Funds.
The computation of the number of green certificate to be received by the Investor will depend on (i) the amount of the EU Structural Funds granted; and (ii) the reference value of the indicators considered by the European Commission during the authorization process of the promoting system (such values to depend on the relevant renewable energy sources/ technology authorized).“
